This Privacy Policy explains how Kaptiv Media LLC ("Kaptiv Media", "we", "us", "our") collects, uses, shares and protects information when you visit kaptiv.media, book a shoot, use our client portal, or otherwise communicate with us.

Kaptiv Media LLC is a real estate media company based in Haslet, Texas, serving the Dallas–Fort Worth metroplex.

2. Information we collect

Information you give us

Contact details — name, email address, phone number, brokerage or company name.
Booking details — property address, access instructions, lockbox or gate codes, occupancy status, shoot date and time, the services you select, and any notes you provide about the property.
Payment information — processed by our third-party payment provider. We receive confirmation of payment and limited details such as the last four digits and card type. We do not store full payment card numbers on our systems.
Communications — emails, text messages, form submissions, and notes from calls with you.

Information we collect automatically

IP address, browser type, device type and operating system.
Pages viewed, time on page, referring website, and links clicked.
Cookies and similar technologies (see section 6).

Media we capture at the property

Photographs, video, aerial (drone) imagery, and 3D scan data of the property, its interior and exterior, and the immediately surrounding area.
This media may incidentally include neighbouring properties, vehicles, licence plates, or people who are present. See section 8.

3. How we use your information

To schedule, prepare for and carry out your shoot.
To edit, process and deliver your images, video and tours.
To take payment and issue invoices and receipts.
To communicate with you about bookings, delivery, reshoots and support.
To send marketing about our services, where you have opted in or where permitted by law.
To display our work in our portfolio, website and social media (see section 8).
To improve our services, website and scheduling.
To comply with legal obligations and enforce our Terms of Service.

4. Text messaging (SMS)

We do not sell, rent, or share mobile phone numbers or SMS consent with any third party for their own marketing purposes. Consent to receive text messages from Kaptiv Media LLC is never shared with third parties or affiliates for marketing. Numbers are shared only with the messaging providers and carriers strictly required to deliver our messages to you.

If you provide your mobile number and opt in, Kaptiv Media LLC may send you two kinds of text message:

Transactional messages — shoot confirmations and reminders, photographer arrival notices, gallery-ready alerts, invoice and payment notices, and replies to your questions.
Marketing messages — promotions, seasonal offers, new service announcements and scheduling availability.

Consent. You opt in by submitting a form on our website or client portal with the consent checkbox ticked, by providing your number during booking, or by texting us first. Consent to receive marketing texts is not a condition of purchasing any goods or services.

Message frequency. Message frequency varies. Transactional messages are sent as needed around your booking. Marketing messages are limited to no more than 4 messages per month.

Cost. Message and data rates may apply. Check with your mobile carrier.

How to stop. Reply STOP to any message to opt out. You will receive one confirmation message and no further texts. Reply HELP for assistance, or contact us at [email protected] or (682) 370-0550.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed on all carriers or devices.

5. Email

We send booking and delivery emails to all clients. We send marketing email only where you have opted in or where we have an existing business relationship with you. Every marketing email contains an unsubscribe link. Unsubscribing from marketing does not stop transactional emails about an active booking.

6. Cookies and tracking

Our website uses cookies and similar technologies to keep the site working, remember your preferences, protect against automated abuse, and understand how visitors use the site.

Essential cookies — required for the site, forms and client portal to function.
Security — we use Cloudflare Turnstile to distinguish human visitors from automated bots on our forms.
Analytics — we may use analytics tools to measure traffic and page performance in aggregate.
Advertising — where we run paid advertising, advertising partners may set cookies to measure results and show you our ads on other platforms.

You can block or delete cookies in your browser settings. Some parts of the site may not work correctly if you do.

7. Who we share information with

We do not sell your personal information. We share it only as follows:

Service providers who operate our business on our behalf — website and CRM hosting, scheduling, email and SMS delivery, payment processing, cloud storage and file delivery, image editing and virtual staging vendors.
Your brokerage, MLS or marketing partners, where you direct us to deliver media to them.
Professional advisers such as our accountants and lawyers, where reasonably required.
Legal and safety — where required by law, subpoena or court order, or to protect our rights, property or safety.
Business transfer — if Kaptiv Media LLC is sold or merged, information may transfer as part of that transaction.

8. Property imagery, occupants and drone operations

Occupants and tenants. If the property is occupied, the client is responsible for notifying occupants and obtaining any consent required before the shoot. We ask that personal items, documents and photographs of identifiable people be removed or concealed before we arrive, and we will avoid capturing them where we reasonably can.

Aerial imagery. Aerial work is flown under FAA Part 107. Aerial images necessarily show the property in its surroundings and may incidentally include neighbouring homes, yards, vehicles and people. We do not target neighbouring properties or individuals.

Removal requests. If you appear incidentally in our imagery, or own a property that does, contact us at [email protected] and we will blur or remove the relevant content from material we control, within a reasonable time.

Portfolio use. Kaptiv Media LLC retains ownership of the media we create and may display it in our portfolio, website, social media and marketing. We do not publish lockbox codes, gate codes, access instructions, alarm details, or client contact information. If you would prefer a particular property not appear in our portfolio, tell us before or at the time of the shoot and we will honour that.

9. How long we keep information

Booking and contact records — for as long as you are a client and afterwards as needed for tax, accounting and legal purposes (generally up to 7 years).
Delivered media — original files are retained for 12 months after delivery; after that, archival is not guaranteed. Download and back up your files.
Marketing lists — until you unsubscribe or opt out.
Access credentials — lockbox and gate codes are deleted promptly after the shoot is complete.

10. Security

We use reasonable administrative, technical and physical safeguards to protect information, including encrypted connections, access controls and reputable third-party providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Your privacy rights

Texas residents

Under the Texas Data Privacy and Security Act, Texas residents may request to:

Confirm whether we process your personal data and access it.
Correct inaccuracies in your personal data.
Delete personal data you provided or that we obtained about you.
Obtain a portable copy of your personal data.
Opt out of the sale of personal data, targeted advertising, or profiling with legal or similarly significant effects.

To exercise these rights, email [email protected] with "Privacy Request" in the subject line. We will respond within 45 days, and may extend once by a further 45 days where reasonably necessary. We may need to verify your identity. If we decline your request you may appeal by replying to our response; if the appeal is denied, you may contact the Texas Attorney General.

Residents of other states

If you live in California, Colorado, Virginia, Connecticut or another state with comparable privacy laws, you may have similar rights. Contact us using the details above and we will honour rights that apply to you. We do not sell personal information and we do not process sensitive personal information for targeted advertising.

12. Children

Our services are intended for businesses and adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.

13. Third-party links

Our website and social channels link to third-party sites we do not control. Their privacy practices are their own, and we encourage you to read their policies.

14. Changes to this policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the most recent version. Material changes will be communicated by email or a notice on this page.
